Deed Restrictions / Covenants
Two very important points to get us started.
First, there is no Homeowners' Association at Appleton Corner and no Homeowners' Association Dues.
Second, if you see anything in the restrictions that is a matter of concern to you, ask. In many cases we can waive or modify a restriction if the circumstances are right.
The following is a summary of the restrictions that exist currently as well as the ones we plan to have in Phases 3 and 4. Consider these guidelines.
General Subdivision Characteristics
- Appleton Corner is intended to be a residential neighborhood, and all property is to be used for that purpose only.
- The lots may not be further subdivided into smaller lots.
- 20 foot easements along each lot line are provided for utility use as needed. This doesn't mean that you can't use this area of your lot, it just means that the utilities such as Tri-County Electric and AT&T can access these areas to maintain any equipment they have.
- The building setbacks are 40' from the front, 50' from the rear, and 20' from the sides of each lot. These cannot be waived. Setbacks are a way of making sure that no buildings are placed right up on the road or right up on an adjacent lot. In a neighborhood like Appleton Corner, the setbacks aren't really a factor for construction due to the size of the lots.
- No more than one home may be constructed on any lot, which does not prevent the construction of an outbuilding such as a garage or barn. See below.
Home Construction
- Homes must be a minimum of 2200 square feet.
- Brick construction is preferred, at least as a veneer on the front of the house. Other construction types will be considered for certain lots, such as hardiplank or stucco.
- Developer will need to approve the plans for the home, including exterior materials and a site plan to include a plan for trees that must be retained. If it makes sense for the neighborhood, you won't have any problems.
- Each home must have a minimum 2 car garage.
- Any outbuildings (garage, workshop, etc) must be constructed in a style similar to that of the residence.
Fencing
- Fencing is permitted upon the approval of the developer of the material and location of the fence. Fences must be in the rear portion of the lot (no fences in the front yards).
Animals (Including Horses)
- Normal domesticated household pets are permitted but must be kept from running free. Horses may be permitted by the developer if a written plan showing the area in which they are to be kept and the facilities for their upkeep. A good rule of thumb is that no more than one horse per acre would be permitted, and that the larger lots of the neighborhood would be preferred for this.
Noise and Nuisances
- Motor vehicles must be licensed and operable if they are kept in sight on any lot. All other vehicles must be kept inside a closed garage.
- No "noxious or offensive" activity is permitted on any lot which may become a nuisance to others in the neighborhood.
- The streets of Appleton Corner are to be used to get to and from the lots. Put simply, we don't want people cruising through the neighborhood in loud vehicles.
Satellite Dishes
- Satellite dishes are permitted. When possible, these dishes should be placed at the rear of the home. Some satellite antennas require a line of sight to multiple satellites in order to receive high definition or specialized programming and may be placed as necessary to receive those signals. Satellite dishes should not be placed in the front yard.
Appearance
- The lots and everything on them must be maintained in a neat manner.
